Founding Lifetime License Terms

These Founding Lifetime License Terms (“Founding Terms”) govern Mutter’s optional Founding Lifetime promotion. They are an agreement between you and Mutter Voice, LLC (“Mutter”), the operator of the Mutter app for macOS and of muttervoice.com. They add to, and form part of, Mutter’s general Terms of Service and Privacy Policy. If anything here conflicts with the general Terms for this promotion specifically, these Founding Terms control. By purchasing a Founding Lifetime license you agree to all of them. If you do not agree, do not purchase it; the standard subscription plans remain available.
- The Founding Lifetime is an optional, limited promotion for early supporters, not a standard product tier. You don’t need it to use Mutter.
- You pay once ($179) and get Mutter’s on-device features on 1 Mac at a time, with app updates, for as long as Mutter is offered: Private dictation, Styles, Dictionary, and your local history.
- As an early supporter you may receive early-stage, beta, or experimental features that can be rough, change, or be withdrawn. You take the offer as it is, with the risks that come with being early.
- Cloud features (cloud transcription, AI rewrite, multilingual cloud processing) are not included. You can add them anytime as a normal subscription.
- It’s a license for one person, tied to your account. You can move it between your own Macs, but you can’t sell, share, or transfer it.
- 14 days, full refund, no questions. A refund ends the license, and that founding seat is retired, never resold.
- Your account is only a license: it never receives your audio, and your dictation history lives on your Mac and stays yours in every case, including refund, revocation, or the end of the product.
1. An optional promotion, offered as-is
The Founding Lifetime is a limited, discretionary promotional offer made available to a capped cohort of early supporters. It is not a standard subscription tier and is not required to use Mutter. We may open, pause, close, change the price of, or withdraw the promotion at any time before purchase; once you have purchased, the license you bought is governed by these Founding Terms. By choosing this promotion over the standard plans, you acknowledge you are knowingly selecting an early-supporter offer and accept the terms, trade-offs, and risks described here.
2. Grant
Subject to your one-time payment and these Founding Terms, Mutter grants the purchasing account holder a personal, non-exclusive, non-transferable, non-sublicensable license (the “Founding Lifetime License”) to install and use the Included Features of the Mutter macOS application on one (1) concurrently activated Mac, for as long as the Mutter application is offered by the operator (the “supported life of the product”). The license does not grant ownership of the software, which is licensed, not sold, and remains ours along with the Mutter name and marks.
3. Included Features
Private on-device transcription; Styles; Dictionary; local dictation history; and updates to the Mutter macOS application. Updates are included in full; there is no major-version upgrade fee for Founding Lifetime holders.
4. Excluded Features
Cloud-processed features, including cloud transcription, cloud AI rewrite and cleanup, multilingual cloud processing, and any future feature whose operation requires the operator’s server-side computation or storage, are not part of this license. Excluded Features may be obtained through a separate subscription; entitlements then combine.
5. Early-stage and beta features; assumption of risk
As an early supporter, you may be given access to features, builds, or capabilities that are pre-release, beta, experimental, or otherwise early-stage. These may be incomplete, unstable, or unsupported; may change materially or be removed without notice; may produce inaccurate or unexpected results; and are provided strictly on an AS-IS and AS-AVAILABLE basis, without any commitment that they will become generally available or reach any particular quality. You acknowledge and accept that early access carries these risks, and you assume them. Do not rely on early-stage features for anything where an error, change, or unavailability would cause you harm, and always review output before relying on it.
6. One person; no transfer; no resale
The license attaches to the purchasing account and may be used by one named individual. Sale, rental, sharing, or transfer of the license or the account is prohibited and voids the license.
7. Device limit
One concurrently activated Mac. You may deactivate a device and activate another at any time through the self-serve tools in your account.
8. Refunds
Full refund within fourteen (14) days of purchase, no questions asked. A refund terminates the license. Retired (“burned”) founding seats are not resold. Outside the 14-day window, the one-time fee is non-refundable except where a non-waivable law requires otherwise.
9. Chargebacks
A payment dispute suspends the license pending resolution. A dispute resolved in your favor restores it; a chargeback of a purchase you have kept terminates the license.
10. Abuse
Sharing the license across persons, automated or fraudulent account creation, circumventing or reverse engineering license validation, or reselling the license entitle us to revoke the license, with a refund of the purchase price at our discretion. Nothing here waives lawful interoperability or security-research rights that cannot be excluded by agreement.
11. Account and privacy
The account carries license entitlements only. License validation transmits the account identifier, an app-generated device identifier, the device name, and the app version, and nothing else; it never transmits audio, transcripts, or the content of your dictation. Your local dictation history is stored on your Mac, is your property, and is never deleted, locked, or modified by any license state, including revocation. Privacy is otherwise governed by our Privacy Policy.
12. Updates and continuity
We intend that the Included Features available under this license at purchase will remain available to it through later updates, and if an Included Feature is rearchitected we will aim to provide a functionally equivalent or better replacement within the license. This is a good-faith commitment about the on-device feature set; it is not a guarantee of uninterrupted operation, of any specific future feature, of compatibility with future versions of macOS or hardware, or of the indefinite continuation of the product, each of which is addressed in the disclaimers below.
13. Disclaimers
The Mutter application, the Included Features, and any early-stage features are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that transcription or cleanup will be accurate, that the software will be uninterrupted, secure, or error-free, that defects will be corrected, or that the product will remain available for any period. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
14. Limitation of liability
To the maximum extent permitted by law, Mutter and its operators, owners, and personnel will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to the Founding Lifetime, the software, or these Founding Terms, even if advised of the possibility. Our total cumulative liability for all claims arising out of or relating to the Founding Lifetime or these Founding Terms is limited to the one-time amount you actually paid for the Founding Lifetime license. This allocation of risk reflects the promotional, one-time, early-stage nature of the offer. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
15. Assumption of risk and release
You acknowledge that you are choosing an optional, early-stage promotional offer, and to the fullest extent permitted by law you assume the risks of doing so and release Mutter from claims arising out of the promotional or early-stage nature of the offer, including changes to, instability of, or withdrawal of early-stage features. This section does not limit liability that cannot be limited by law, such as liability for gross negligence, fraud, or willful misconduct, and it does not waive rights that applicable consumer-protection law makes non-waivable. Where the law does not permit a full release, this section applies to the greatest extent it does.
16. Disputes; class-action waiver; time limit
Before filing any claim, you agree to first contact support@muttervoice.com and give us thirty (30) days to resolve it informally. To the extent permitted by law, any dispute will be brought only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding, and you and Mutter each waive any right to a jury trial. Any claim arising out of or relating to the Founding Lifetime must be brought within one (1) year after it arises, or it is permanently barred, except where a non-waivable law provides otherwise.
17. Changes to these terms
We may update these Founding Terms as the product and promotion evolve. If a change is material we will update the date above and give holders notice. Changes will not retroactively remove an Included Feature from a license you have already purchased, consistent with Section 12.
18. Governing law
These Founding Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws principles, except where a non-waivable consumer-protection law of your home jurisdiction applies. If any provision is found unenforceable, it is limited or severed to the minimum extent necessary and the remainder stays in effect. Billing is handled by our merchant of record, whose own checkout terms apply to the payment itself.
